1. GENERAL

1.1. These terms and conditions ("Terms") explain your rights and obligations in relation to this web site located at www.menswearonline.co.uk ("Site") and any goods purchased through this Site. Please read them carefully. You may have other rights granted by law and these Terms do not affect these. If there is anything you do not understand then please contact us.

2. USE OF THE SITE

2.1. The content of and copyright in the Site is owned by or licensed to us. You are permitted to view or print individual pages for your own personal use. Any other use must be with our prior written permission.

2.2. We reserve the right to suspend, restrict or terminate your use of this Site at any time.


3. PURCHASING FROM US

3.1. The Site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to despatch of such goods. If you are unhappy with these improved, altered or modified goods you may inform us within 7 days, starting on the day after the goods are delivered to you. In order to receive a refund, the goods must be returned in their original unworn condition and with all packaging and tags etc. intact , together with your receipt. We recommend that you retain all of the original packaging and tags until you are sure that you intend to keep the goods. (Please note: Carriage costs will be refunded only if the item is faulty, or if it differs in any way from the advertised goods.) Please see our specific 'Delivery & Returns Policy' which forms an additional part of these 'Terms and Conditions of Sale'.

3.2. Whilst we try to display goods on our Site that are held in stock, if the ordered goods are not available we will advise you of this as soon as reasonably possible. You will be given the option of waiting for the item to be restocked, ordering an alternative product or receiving a full refund.

3.3. By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors).

3.4. We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. Your order will be deemed to have been accepted when we despatch to you the goods which form the subject matter of your order. We may at our total discretion reject your order.

3.5. All drawings, specifications, sizes, photographs, descriptive matter and advertising published by us or contained on our Site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the Terms.


4. PRICING

4.1. All prices are in British Pounds and include Value Added Tax. We reserve the right to adjust the VAT element if this changes from 17.5%. The cost of transporting goods ("Carriage & Insurance Costs") are as set out within our 'Delivery & Returns Policy' here and are based on the shipping location. These Carriage & Insurance Costs shall be added to the price to be paid by you.


5. DELIVERY

5.1. We aim to deliver goods to you within 3-5 working days but we cannot give an exact delivery date. If we are unable to deliver the goods within 30 days of receiving your order, we will inform you, then if you wish, you may cancel the contract and we will refund any money paid by you.

6. DAMAGED OR DEFECTIVE GOODS

6.1. You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible before wearing the item and refer to our 'Delivery & Returns Policy' here for instructions on how to return an item.


7. LIMITATION OF LIABILITY

7.1. We do not limit our liability to you for death or personal injury caused by our negligence or for fraud.

7.2. All reasonable efforts have been made to try to ensure that the information contained on the site is correct and up to date. However, we can not guarantee this is the case and we shall not be liable for inaccuracies or for your reliance on incorrect or out of date information whilst we will try to take all reasonable steps to protect your personal details, we cannot guarantee the security of any data you disclose on-line and will not be responsible for any breach of security unless this is due to our negligence. We do not have any liability to you arising out of your use or inability to use the site. We will not be liable to you for any unforeseeable losses.

7.3. We will be excused performance of any of our obligations of caused by circumstances beyond our reasonable control or beyond the reasonable control of our suppliers, including without limit industrial disputes, war, flood and changes in legislation.

7.4. Save as set out in clause 7.1, our liability to you for:

Damage to physical property caused by our negligence or by the goods shall not exceed £5,000 per event or series of connected events;

Subject to clauses 7.1 and 7.4, the aggregate of all claims arising in connection with the goods (whether due to breach of contract, or negligence, or otherwise) shall not exceed the price paid by you in respect of the goods that are the subject matter of the claim in question.

Except as set out in paragraph 5 above or as otherwise set out in this agreement, we disclaim all terms, conditions, representations and warranties (whether express or implied) to the extent permissible by law.

8.1. Any personal details you provide to us are kept and processed in accordance with our Privacy Statement (see below).

8.2. This Site may contain links to other web sites not under our control. We accept no responsibility or liability for the content or availability of those sites.

8.3. We may not necessarily keep a copy of these Terms and your order. We advise you to print a copy of them for your information in the future.

8.4. If any section of the Terms are held by a Court or other competent authority to be unenforceable then that section shall be considered deleted and not apply but the rest of the Terms will.

8.5. This agreement between us is personal to us and no other person who is not party to these Terms shall be entitled to enforce any term of this Agreement under the Contracts (Rights of Third Parties) Act 1999 (or any analogous laws).

8.6. The Terms are the entire terms and conditions between us in relation to your use of this Site and any purchase made over the Site and no other terms, conditions or representations made by us and any of our employees or agents (unless made fraudulently) shall apply.

8.7. The Terms shall be governed by English law and the courts of England and Wales shall have non-exclusive jurisdiction over any dispute. All dealings, correspondence and contact between us shall be made or conducted in the English language.

If you are a consumer (i.e. you are not purchasing either wholly or in part for your business or you are not a business) you have the right, in addition to your other rights, to cancel the contract and receive a refund. You must inform us if you wish to cancel within 7 days, starting on the day after the goods are delivered to you. If you choose to cancel then the goods must be returned to us in their original unworn condition and with all packaging and tags etc. in tact, together with your receipt. Please note that Carriage & Insurance Costs can only be refunded if the goods are faulty. Please refer to our 'Delivery & Returns Policy' for full details on how to return an item.
Making A Purchase

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept credit and debit card payment. We regret that at this time, we are unable to ship to North America or its territories.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. Shipping And Handling

Menswear Online Delivery Policy


1. DESPATCH

1.1. We attempt to ship an order the same working day it is placed. If the item is not in our stock, we will contact our suppliers and it will be dispatched to you the same day we recieve it.

1.2. If there is a problem with your order preventing us from dispatching, we will normally contact you within 24 hours of the order being received by us or on the next working day.

1.3 We regret that at this time we are unable to ship to countries in North America. This includes Antigua and Barbuda,The Bahamas,Barbados,Belize,Canada,Costa Rica, Cuba, Dominica, Dominican Republic, El Salvador, Greenland (Kalaallit Nunaat), Grenada, Guatemala, Haiti, Honduras, Jamaica, Mexico, Nicaragua, Panama, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Trinidad and Tobago and the United States of America


2. DELIVERIES

2.1. Deliveries are normally made within 2-3 working days from dispatch unless advised otherwise or if being sent outside of the UK.

2.2. All deliveries are currently sent via Royal Mail 1st Class Recorded Delivery. Under certain circumstances, your order may be shipped on a priority service such as Royal Mail Next Day Delivery.

2.3. Please ensure that someone is available at your delivery address to accept the goods, as a signature is normally required.


3. OVERSEAS ORDERS

3.1. If your order is shipped outside the UK, there is a generic £10 charge for all international deliveries. This is added at the point of checkout.

3.2. While we do not expect that there will be any additional charges attached to your order, we recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your on-line order with Menswear Online.


4. DELIVERY CHARGES

4.1 1st class postage in the UK is free on all orders.

4.2 Priority services are avialablee on request however these may incur an additional charge.

5. RETURNS POLICY

5.1. You can return all unaltered goods and receive a refund, if you do so within 7 days from the date of delivery. Delivery costs are not refunded unless the goods are found to be faulty. Please note that the goods must be returned in their original unworn condition and with all packaging and tags etc. intact.

5.2. If the goods delivered are faulty or have been damaged in transit, then we will either exchange the goods free of charge, or give you a full refund including delivery costs, providing the goods are returned to us within 7 days from the date of delivery.

5.3. We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags.

5.4. Menswear Online will not accept returns for any non-faulty items or items that have been worn and tags removed. Upon receipt of an order, if any item has been received with no tags, customers should notify us on the same day if they wish to return.

5.5. In all circumstances you must contact us first in writing.

5.6. Please ensure you have read and understood thoroughly 'How to return or exchange an item' below before returning goods.


6. EXCHANGES

6.1. If the ordered is in the wrong size and an exchange is required, this can be provided but a delivery charge will be incurred. Please note the goods must be in their original condition and packaging with all tags etc. intact, as we cannot exchange used goods. Please see 'Returns' section above for specific conditions.

6.2. All exchanges are offered subject to product availability and the customer will incur any shipping costs for such exchanges.

6.3. Exchanged items will only be dispatched after the returned goods have been received complete and undergone a quality control check.

6.4. Please ensure you have read and understood thoroughly 'How to return or exchange an item' below before exchanging goods.


7. HOW TO RETURN OR EXCHANGE AN ITEM

7.1. In order to facilitate the return of your items you must contact us first in writing, either to 59 West Street, Horsham, West Sussex, RH12 1PN or email orders@menswearonline.co.uk in order to inform us of your intentions. This must be done within 7 days of receiving your order. We reserve the right to refuse returns if this procedure is not followed.

7.2. Please ensure that you enclose your original invoice/packaging slip with the items you are returning along with a note giving the reason for the return or the exchange. Please then wrap the package safely & securely and send it to the address below. In the case of a defective item, please in addition provide a full description of the fault and again, send it to us in its original condition and all packaging and tags etc. intact. 7.3. For your protection we strongly recommend that you use a recorded-delivery service or a courier that will offer proof of delivery. Proof of posting is not proof of receipt and all goods remain the responsibility of the customer until they are received back by Menswear Online.


8. REFUNDS

8.1. All items must be returned to us following the guidelines and conditions above before a refund or replacement is issued.

8.2. Refunds to you will normally be made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser's credit/debit card excluding shipping charges unless faulty (please see above). As previously stated in our Delivery Policy, international customs duties and sales taxes are non-refundable for shipments outside the European Community (EU).


9. CANCELING AN ITEM

9.1. Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within seven working days of delivery. However, we regret that we cannot accept cancellations of orders where the item has been worn, not in its original condition or without all its packaging and tags.

9.2. For your protection we strongly recommend that you use a recorded-delivery service or a courier that will offer proof of delivery. Proof of posting is not proof of receipt and all goods remain the responsibility of the customer until they are received by Menswear Online. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty.

9.3. This Delivery & Returns policy does not affect your statutory rights as a consumer.

Delivery Schedule When an item is in stock, we attempt to ship it the same day. If your order is not in stock, we will aquire it from our suppliers and dispatch it to you the same day we recieve it. Orders received at weekends or public holidays, will be sent on the next working day.

If there is a problem with your order preventing us from dispatching, we will normally contact you within 48 hours of the order being received by us or on the next working day.

Back Orders

If your item is not in stock, we will contact you as soon as reasonably possible. Tax Charges

For orders made from the UK or the European Union, 17.5% VAT is included in the price advertised on the site. All other orders are VAT free.
